Chapter I General

Article 1 In order to strengthen the supervision and management of measurement, ensure the uniformity and value of the national measurement unit system, and be accurate and reliable, which is conducive to the development of production, trade, science and technology, adapt to the needs of socialist modernization, safeguard the interests of the country and the people, and formulate This law.

Article 2 In the territory of the People's Republic of China, the establishment of measuring reference equipment, measuring standard equipment, measuring and measuring, manufacturing, repairing, selling and using measuring instruments must comply with this Law.

Article 3 The State adopts the International System of Units.

The unit of measurement of the International System of Units and other units of measurement selected by the State are the national legal units of measurement. The name and symbol of the national legal measurement unit shall be announced by the State Council.

Non-national legal measurement units shall be abolished. The method of abolition shall be formulated by the State Council.

Article 4 The metrological administrative department of the State Council shall implement unified supervision and management of the national measurement work.

The metrological administrative department of the local people's government at or above the county level shall supervise and manage the measurement work within its administrative region.

Chapter II Measurement Standard Apparatus, Measurement Standard Apparatus and Measurement Verification

Article 5 The metrological administrative department of the State Council is responsible for the establishment of various measurement benchmark instruments as the highest basis for unifying the national value.

Article 6 The metrological administrative department of the local people's government at or above the county level shall, according to the needs of the region, establish social public measurement standard instruments, which shall be used after being qualified by the metrological administrative department of the higher-level people's government.

Article 7 The relevant competent departments of the State Council and the relevant competent departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may, according to the special needs of their respective departments, establish the measurement standard instruments used by their respective departments, and the highest measurement standard instruments shall be measured and administered by the people's government at the same level. The department will use the test after passing the examination.

Article 8 Enterprises and institutions may, according to their needs, establish the measurement standard instruments used by their own units, and the highest measurement standard instruments shall be used after being qualified by the relevant metrological administrative department of the people's government.

Article 9 The metrological administrative department of the people's government at or above the county level shall impose mandatory measures on social public measurement standard instruments, departments and enterprises, institutions, and the highest measurement standard instruments used in trade settlement, security protection, medical care, and environmental monitoring. The working measuring instruments of the catalogue are subject to mandatory verification. If it fails to apply for verification or fails to pass the test in accordance with the regulations, it shall not be used. The catalogue and management methods for work measurement instruments that implement mandatory verification shall be formulated by the State Council.

For other measurement standard instruments and work measuring instruments other than the provisions of the preceding paragraph, the user unit shall periodically verify or send it to other metrological verification institutions for verification, and the metrological administrative department of the people's government at or above the county level shall conduct supervision and inspection.

Article 10 The metrological verification must be carried out in accordance with the national metrological verification system table. The national metrological verification system is formulated by the metrological administrative department of the State Council.

Metrological verification must perform metrological verification procedures. The national metrological verification procedures shall be formulated by the metrological administrative department of the State Council. Where there is no national metrological verification procedure, the relevant competent departments of the State Council and the metrological administrative departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall separately formulate departmental metrological verification procedures and local metrological verification procedures.

Article 11 The measurement and verification work shall be carried out on the spot in accordance with the principle of economic rationality.

Chapter III Management of Measuring Instruments

Article 12 Enterprises and institutions that manufacture and repair measuring instruments must have facilities, personnel, and testing equipment that are compatible with the measuring instruments that are manufactured and repaired, and are qualified by the metrological administrative department of the people's government at or above the county level. Manufacturing Measurement Instruments License or Repairing Measurement Instruments License.

Article 13 Enterprises and institutions that manufacture measuring instruments that produce new products of measuring instruments that have not been produced by the unit must pass the assessment of the measurement performance of their samples by the metrological administrative department of the people's government at or above the provincial level before they can be put into production.

Article 14 Without the approval of the metrological administrative department of the people's government of a province, autonomous region or municipality directly under the Central Government, it is prohibited to manufacture, sell or import measuring instruments of the unlawful fixed measurement unit stipulated by the State Council and other measuring instruments prohibited by the State Council.

Article 15 Enterprises and institutions that manufacture and repair measuring instruments must verify the measuring instruments manufactured and repaired to ensure that the metering performance of the products is qualified, and issue product certification certificates for qualified products.

The metrological administrative department of the people's government at or above the county level shall supervise and inspect the quality of the measuring instruments manufactured and repaired.

Article 16 The use of measuring instruments shall not destroy their accuracy and harm the interests of the state and consumers.

Article 17 Individual industrial and commercial households may manufacture and repair simple measuring instruments.

Individual industrial and commercial households that manufacture and repair measuring instruments must pass the examination of the metrological administrative department of the people's government at the county level and issue the “Permit for Manufacturing Measuring Instruments” or the “Permit for Repairing Measuring Instruments”.

Chapter IV Measurement Supervision

Article 18 The metrological administrative department of the people's government at or above the county level shall set up metrological supervisors as needed. The measures for the management of measurement supervisors shall be formulated by the metrological administrative department of the State Council.

Article 19 The metrological administrative department of the people's government at or above the county level may set up a metrological verification institution according to the needs, or authorize the metrological verification institutions of other units to perform compulsory verification and other verification and testing tasks.

Those who perform the verification and testing tasks specified in the preceding paragraph must pass the examination.

Article 20 The disputes arising from the accuracy of measuring instruments shall be subject to the data verified by the national standard measuring instruments or the social public measuring standard instruments.

Article 21 The product quality inspection agency that provides notarized data for the society must pass the assessment of the capacity and reliability of the metrological verification and testing by the metrological administrative department of the people's government at or above the provincial level.

Chapter V Legal Liability

Article 22 If the manufacturer or repair of measuring instruments is not obtained without the license for manufacturing measuring instruments or the license for repairing measuring instruments, it shall be ordered to stop production, stop business, and confiscate the illegal income, and may impose a fine.

Article 23 If a new product of a measuring instrument that has not passed the examination is manufactured or sold, it shall be ordered to stop the manufacture and sale of the new product, and the illegal income shall be confiscated and a fine may be imposed concurrently.

Article 24 If the measuring instruments manufactured, repaired or sold are unqualified, the illegal gains shall be confiscated and a fine may be imposed concurrently.

Article 25 If a measuring instrument that falls within the scope of compulsory verification fails to apply for verification or fails to pass the test according to the regulations, it shall be ordered to stop using it and may be imposed a fine concurrently.

Article 26 If an unqualified measuring instrument is used or the accuracy of the measuring instrument is damaged, causing losses to the state and consumers, it shall be ordered to compensate for the loss, the measuring instrument and the illegal income shall be confiscated, and the fine may be imposed concurrently.

Article 27 Whoever manufactures, sells or uses measuring instruments for the purpose of deceiving consumers shall be fined for the confiscation of measuring instruments and illegal gains; if the circumstances are serious, and the persons directly responsible for the individual or the unit shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law. .

Article 28 Whoever violates the provisions of this Law and manufactures, repairs or sells measuring instruments that are unqualified, resulting in personal injury or serious property damage, shall be investigated for criminal responsibility of the person directly responsible for the individual or the unit in accordance with the relevant provisions of the Criminal Law.

Article 29 If a supervisory supervisor violates the law and dereliction of duty, if the circumstances are serious, he shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law; if the circumstances are minor, administrative sanctions shall be imposed.

Article 30 The administrative penalties prescribed in this Law shall be determined by the metrological administrative department of the local people's government at or above the county level. The administrative penalties prescribed in Article 27 of this Law may also be decided by the administrative department for industry and commerce.

Article 31 If a party is dissatisfied with the decision on administrative punishment, he may file a suit in a people's court within 15 days of receiving the notice of punishment; if the administrative penalty for fines or confiscation of illegal income is not prosecuted and fails to be performed, The organ that makes the administrative punishment decision applies to the people's court for enforcement.

Chapter VI Supplementary Provisions

Article 32 The measures for the supervision and administration of the measurement work of the People's Liberation Army and the national defense science and technology industrial system shall be formulated separately by the State Council and the Central Military Commission in accordance with this Law.

Article 33 The metrological administrative department of the State Council shall formulate the implementation rules in accordance with this Law and submit it to the State Council for approval and implementation.

Article 34 This Law shall come into force on July 1, 1986.
